Brophy murder case: Jail visitor info stays sealed

PORTLAND, Ore. (KOIN) — Attorneys for accused killer Nancy Crampton Brophy — the novelist who write a 2011 essay titled “How to Murder Your Husband” — successfully managed to keep the jail visitor logs and probable cause documents related to her case sealed for another few months.

The 68-year-old novelist used a 9mm pistol to kill her husband Daniel Brophy at the Oregon Culinary Institute back in June 2018.

A lot of questions remain in the case since the probable cause documents along with the jail visitor log remain under seal — information which is usually considered public record. 

The state requested the judge unseal the documents, but Crampton Brophy’s attorney argued unsealing them puts the defense at a disadvantage — calling it unconstitutional.

The judge agreed.

“I’m comfortable that it’s my constitutional responsibility to make sure Ms. Brophy gets a get trial,” Judge Kenneth Walker said. “In that light, I’m going to continue the seal and protective order in not releasing additional information.”

Crampton Brophy is still in custody and waived her right to appear during Friday morning’s motion hearing.

Her bail hearing was pushed back to April 19. At that time, the judge said he plans to unseal the information.
