PORTLAND, Ore. (KOIN) — A man, who police said attacked his girlfriend with a samurai sword, was sentenced to up to 40 years at the Oregon State Hospital on Wednesday after he plead not guilty on charges of kidnapping and attempted murder.
David McDaniel, 51, was found guilty except for insanity, putting him under the Oregon Psychiatric Security Review Board’s jurisdiction.
A psychiatric assessment, according to court documents, showed McDaniel “lacked substantial capacity to appreciate the criminality of his conduct.” An assessment also said that McDaniel’s psychosis caused auditory hallucinations and delusions of persecution.
McDaniel was arrested on Feb. 12 in Portland — 4 days after his girlfriend reported that he attacked her in Scappoose. Police said she had several injuries to her neck and back.
On the way back to Columbia County from Portland, while McDaniel was in custody, Scappoose Police said he caused damage to the back passenger side of an officer’s patrol car. They said he was non-compliant.
McDaniel has served 137 days in incarceration so far.
