PORTLAND, Ore. (AP) – The Oregon Court of Appeals says a jury should hear a lawsuit filed by the family of a Peruvian teenager killed in a mass shooting outside a downtown Portland nightclub.
In January 2009, a gunman opened fire outside The Zone, an underage nightclub that has since closed. He killed two teenage girls and wounded seven other people before killing himself.
A lawsuit filed by the estate of Martha Paz de Noboa Delgado says The Zone’s owner knew the club was in an area prone to violence and didn’t do enough to make the premises safe.
The trial judge ruled the shooting was unforeseeable. But the Appeals Court said Wednesday that a jury might disagree, given the area’s history of violence. The decision sends the case back to Multnomah County.
