PORTLAND, Ore. (PORTLAND TRIBUNE) — Prosecutors say a 25-year-old driver was allegedly intoxicated with “psilocybin type drugs” during a serious crash that left her male passenger with a traumatic brain injury.
“Physicians are keeping the passenger alive via life support measures only and there is not an expectation the passenger will survive after life support is removed,” according to a probable cause affidavit filed in Multnomah County Court on Dec. 19.
Rachel Delanie Banks faces charges of driving under the influence of intoxicants, second-degree assault and reckless driving.
Portland Police say Banks was driving south on Interstate 205 around 9:58 p.m. when she began to “fishtail” and then swerved into construction barrels and two construction trucks. The vehicle slid over 30 feet.
Firefighters responding to the Southeast Stark Street overpass cut off the roof of the car and extracted the passenger, according to court docs.
Prosecutors claim that Banks was “dazed and confused” with dilated eyes and a “relaxed flaccid” facial expression. An officer at the scene said she did not smell like alcohol but concluded from her behavior that she was intoxicated.
“Banks kept telling [Officer Sorensen] that she had not been in a crash and, when asked to identify her passenger, stated she was alone,” according to the affidavit. “Banks reported that she had bought some drugs, but had not yet used them.”
Banks is in custody at a local hospital at this time.
