PORTLAND, Ore. (KOIN) — The 25-year-old woman accused of crashing a car in a construction zone on I-205 has been charged with manslaughter. 

The indictment against Rachel Banks was filed Wednesday in Multnomah County Circuit Court. She’s facing charges of second-degree manslaughter, driving under the influence and reckless driving, according to the Multnomah County District Attorney’s Office. 

Portland police said Banks was driving south on I-205 around 10 p.m. December 18 when she began to “fishtail” and then swerved into construction barrels and 2 parked construction trucks under the SE Stark overpass, then slid more than 30 feet.

Firefighters rushed to the scene and had to cut the roof off the car to get the passenger out, court documents said.

That passenger — 21-year-old Calvin M. Biltimier — died a week after the crash. 

Police accuse Banks of driving while high on psilocybin-type drugs. She pleaded not guilty to charges of DUII, assault and reckless driving on Dec. 26 — a day after Biltimier’s death. 

Banks will remain in the custody of the Multomah County Sheriff’s Office. She’s due back in court on Feb. 19.
